The Superintendence of Industry and Commerce, as National Authority for Consumer Protection, sanctioned DIRECTV COLOMBIA, with a fine of COP $245,000,000 for failing to comply with the right of users to have their requests and complaints addressed and resolved in a timely manner.
The Superintendence of Industry and Commerce (SIC), in its role as National Authority for Competition Protection, sanctioned RICHARD ALEXANDER CASTRO ARTEAGA and DIEGO ADOLFO ROBLES BOLAÑOS with a fine of COP $101,508,684 for bid rigging in 15 different selection processes carried out between 2013 and 2017 in the construction sector, in different cities of the Department of Nariño.
The SIC also sanctioned JONATHAN IVÁN ASCUNTAR PORTILLA and JAMES ANDRÉS ASCUNTAR PORTILLA for having collaborated and facilitated these anticompetitive agreements.
The Superintendence of Industry and Commerce (SIC), as National Authority for Consumer Protection, executed twenty-four (24) administrative inspections in establishments that provide parking services, in three crowded areas of Bogotá. This operation aimed to verify the compliance to provide information on the conditions of service, such as date, time, modality, site conditions, payment systems, among others, as well as the requirements to guarantee the safekeeping and adequate protection of vehicles.
The Superintendence of Industry and Commerce (SIC), in its role as National Authority for Competition Protection, sanctioned ORGANIZACIÓN ROA – FLOR HUILA (ORF) and three individuals with fines up to COP $20.514.597.205 for failing to comply with instructions and information requirements and obstructing the administrative visit carried out by this Authority in the facilities of the Department of Casanare, Colombia.
The Superintendence of Industry and Commerce (SIC), in its role as National Authority for Competition Protection, imposed precautionary measures on VISA (VISA COLOMBIA and VISA COLOMBIA SUPPORT SERVICES) and MASTERCARD (MASTERCARD COLOMBIA ADMINISTRADORA and MASTERCARD COLOMBIA ICN SUCURSAL COLOMBIANA) for the possible commission of restrictive practices within the framework of the payment system in foreign trade, through credit and debit cards.
The case:
Esta Superintendencia mediante Resolución No. 37344 de 2022, sancionó a TRANSPORTES ESPECIALES F.S.G. S.A.S. (en adelante FSG), HDL LOGÍSTICA S.A.S. (en adelante HDL), y a funcionarios públicos, al quedar demostrado que, al menos hasta el 2018 materializaron una serie de acuerdos contrarios al régimen de libre competencia, por medio de los cuales eliminaron la presión competitiva en un número de procesos de subastas públicas adelantadas por la sociedad de economía mixta CENTRAL DE INVERSIONES S.A. (en adelante CISA).
Esta Superintendencia en uso de sus facultades legales, estudió y aceptó un esquema de garantías presentado por BAVARIA & CIA S.C.A.
Esta Superintendencia mediante Resolución No. 44505 del 11 de julio de 2022 sancionó a dos (2) personas naturales por haberse cartelizado en distintos procesos de selección contractual adelantados por entidades contratantes del Departamento de Nariño. La conducta desplegada por estos agentes del mercado contravino lo dispuesto en el numeral 9 del artículo 47 del Decreto 2153 de 1992 (colusión en procesos de contratación del Estado).
La Superintendencia de Industria y Comercio mediante Resolución No. 42815 del 6 de julio de 2022, sancionó a ALIANZA MAYORISTA S.A.S. (en adelante ALIMA), DISPRESCO S.A.S. (en adelante DISPRESCO) e INTERNACIONAL DE ABASTOS Y LICORES S.A.S. (en adelante INTERLICORES) al crear una UNIÓN TEMPORAL para ejecutar de manera continuada una serie de acuerdos y estrategias en el mercado de distribución de los licores, los cuales eran producidos por la FABRICA DE LICORES DE ANTIOQUIA (en adelante FLA) en el departamento de Antioquia.
