Following a lawsuit presented by the CENTRAL CERVECERA DE COLOMBIA (company dedicated to the production of beer) and POSTOBÓN (company dedicated to the production and marketing of non-alcoholic beverages), the Deputy Superintendence for Jurisdictional Affairs of the Superintendence of Industry and Commerce (SIC), declared that BAVARIA (company dedicated to the production, transformation and commercialization of beers) was guilty of incurring in unfair competition through unfair exclusivity agreements, which is prohibited by Article 19 of Law 256 of 1996. 

In the decision, BAVARIA was ordered to refrain from signing supply contracts that include exclusivity clauses for the sale of beer in the future. The other claims of the lawsuit, including the declaration of dominant position of BAVARIA, were denied.

BAVARIA filed an appeal against this decision, which will be resolved by the Superior Court of Bogotá.
