SIC sanctions Win sports for streaming service failures during colombian football broadcasts
The Superintendence of Industry and Commerce (SIC), as National Authority for Consumer Protection, imposed a fine of $284,200,000 COP (approximately $72,820.51 USD) against WIN SPORTS S.A.S. and ordered them to inform consumers about their terms and conditions, the circumstances that may lead to service interruptions or latency issues, as well as to include a risk management procedure to identify and assess potential failures and implement mechanisms to prevent them.
This decision was made following administrative investigations that proved multiple service failures on their streaming platform, WIN SPORTS ONLINE. These failures prevented users from accessing sports event broadcasts or resulted in latency or interruptions.
The SIC found that these service failures happened in a context of additional consumer vulnerability, as the social impact of the COVID-19 prevented them from attending sports events in person. Consequently, consumers turned to streaming content, especially for football matches, which were exclusively offered through WIN SPORTS ONLINE, as it held the exclusive broadcasting rights granted by the Colombian Professional Football Division (DIMAYOR).
