Sic fines Movistar for misleading advertising in plans that offered Netflix and Amazon prime
The Superintendence of Industry and Commerce (SIC), as National Authority for Protection of Users of Communication Services, has imposed a fine to COLOMBIA TELECOMUNICACIONES (MOVISTAR) for COP $868,000,000 (about USD $180,000) for misleading advertising regarding a promotion that stated users could activate their accounts or services for NETFLIX and AMAZON PRIME for free when purchasing specific data plans.
The SIC found that MOVISTAR failed to comply with its obligation to provide timely, clear, precise and sufficient information regarding the conditions and details behind their ads, for example, additional requirements to activate and access the streaming platforms’ services were not disclosed to consumers in the advertising material.
In some cases, it was found that MOVISTAR, charged customers for these applications without their previous and express consent in order to activate the service.
